1. Eligibility for Returns:

  • Due to the highly personalized and unique nature of custom-made garments, they are not eligible for returns or exchanges. We create each item specifically according to your individual preferences, measurements, and design choices.

2. Quality Assurance:

  • We maintain strict quality control standards to ensure that your custom-made garment meets our high-quality benchmarks. Our team of skilled artisans and designers works diligently to craft each piece to your satisfaction.

3. Modifications and Alterations:

  • If there are any issues with the fit or construction of your custom-made garment, please contact our customer service team within 3 of receiving your order. We will work with you to resolve any concerns and, if necessary, discuss potential modifications or alterations to achieve the desired fit and style.

4. Incorrect or Defective Items:

  • In the rare event that you receive an item that is incorrect or defective due to an error on our part, please contact us within 3 days of receiving your order. We will arrange for a product replacement (same style), as appropriate, at no additional cost to you.

5. Care Instructions:

  • To ensure the longevity of your custom-made garment, please follow the care instructions provided with your order. Failure to do so may void any potential resolution for concerns related to wear and tear.

Commission Terms of Service

Thank you for your interest in commissioning a bespoke design from Harleen Middleton. Please carefully review the following terms before submitting your commission request.

1. Commission Process: 1.1 To initiate the commission process, fill out the provided commission form in its entirety. 1.2 Upon receipt of your commission request, Harleen Middleton will review the details and contact you within 14 business days to discuss further details and confirm feasibility. 1.3 Once the commission details are finalized, Harleen Middleton will provide you with a cost estimate and timeline for the project.

 

2. Payment: 2.1 A non-refundable designer fee of $250 is required to cover the time spent by the designer creating the concept art and quote for the client. 2.2 This designer fee is separate from the deposit mentioned elsewhere in these terms and is payable upon submitting this form 2.3 Once the client receives the invoice, 25% of the total estimated invoice is due within 3 days. 2.4 The remaining balance, excluding the designer fee, must be paid in full prior to the delivery of the commissioned design.

 

3. Design Ownership and Usage: 3.1 Upon full payment, the commissioned design becomes the physical property of the client. 3.2 The design concept, creation process, and any mechanics are proprietary rights of Harleen Middleton. The client cannot submit the final product into any (including but not limited to) contests and competitions. If the client breaks this, Haus of Harleen is within their right to sue for the awarded amount and any preceding damages. 3.3 The client agrees not to reproduce or resell the commissioned design. 3.4 The customer cannot claim this as their own work or creation. If done, Haus of Harleen can take legal action to protect its rights.

 

4. Changes and Revisions: 4.1 Minor adjustments to the commissioned design can be made during the design process. Please note that the estimated price may change due to fluctuations in the cost of goods and the designer's schedule. 4.2 Major design changes requested after the initial concept approval will incur additional fees of no less than $300 and extend the project timeline.

 

5. Delivery: 5.1 The completed commissioned design will be delivered to the client in the agreed-upon format (e.g., digital file, physical garment). 5.2 Shipping costs, if applicable, will be covered by the client and added to the final invoice.

 

6. Cancellation and Refunds: 6.1 Commission slots can be canceled by the client at any time, but the initial deposit and designer fee are non-refundable. Once the creation process begins, if the client cancels there is no refund on that which has been paid are responsible for no less than 50% of the remaining balance. 6.2 There is no guarantee or promise that your request will arrive prior to your “needed by” date. This depends on the demand of the designer at any time during the creation process. 6.3 The designer books out over 8 months in advance and it could take up to 3 years to receive your final product based on complexity and prior obligations of the designer.

 

7. Confidentiality: 7.1 Harleen Middleton agrees to keep all client information and commission details confidential. 7.2 The client agrees not to disclose any proprietary information shared by Harleen Middleton during the commission process or thereafter.

 

8. Governing Law: 8.1 These terms of service shall be governed by and construed in accordance with the laws of New York, without regard to its conflict of law provisions. 8.2 Any disputes arising out of or relating to these terms shall be resolved through arbitration in New York.

By submitting the commission form, you acknowledge that you have read, understood, and agree to abide by these terms of service.
